RECO
(No. 36.) Sir,
The Marquess of Lansdowne to Mr. Johnstone. RES 23 AUG 05
Foreign Office, August 10, 1905.
I HAVE received your despatch No. 66 of the 27th ultimo, stating the willingness of the Danish Government to enter into an arrangement with His Majesty's Govern- ment for the reciprocal protection of British and Danish trade-marks in China.
Before effect can be given to such an arrangement it is necessary that His Majesty's Minister at Peking should be satisfied that effective provision exists for the punishment in the Danish Consular or other Courts in China of Danish subjects who may infringe British trade-marks in that country.
I shall be glad, therefore, if you will make inquiries of the Danish Government on the subject, and report to me whether such punishment is provided for by Danish law.
On learning from you that the Danish Courts in China are competent in such matters I will inform Sir E. Satow, and will request him to issue the necessary instructions to His Majesty's Consular officers in that country directing them to allow British subjects who may infringe Danish trade-marks to be prosecuted in their Courts.
I am, &c.
LANSDOWNE,
(Signed)
